A Federal High Court in Abuja has affirmed the candidature of Mr Napoleon Gbinije as the rightful candidate of the Democratic People's Party [DPP] for the Okpe/Sapele/Uvwie Federal constituency of Delta State in the April ninth National Assembly elections.

Delivering judgment in the suit filed by Mr Napoleon Gbinije against the Independent National Electoral Commission [INEC], Democratic People's Party and Michael Omuvwie, Justice Adamu Bello ruled that Mr Gbinije is the only legitimate candidate of the Democratic People's Party having won the highest number of votes at the end of the primaries conducted on the thirteenth of January, 2011 for Okpe/Sapele/Uvwie Federal constituency.

The court ordered that the Independent National Electoral Commission acted illegally when it published the name of Mr Michael Omuvwie as the candidate of the Democratic People's Party for Okpe/Sapele/Federal Constituency of Delta State.

Justice Adamu Bello therefore granted an order of perpetual injunction restraining INEC and the DPP from recognizing Michael Omuvwie as the candidate of the party for Okpe/Sapele/Uvwie Federal constituency in the April 9 National Assembly elections.

The court also restrained Mr Michael Omuvwie from parading himself as the candidate of the DPP for Okpe/Sapele/Uvwie Federal constituency of Delta state.
