What is now left after the much heated debate of "Where is Yar'adua " is the Section 144 of Nigerian Constitution.
Section 144 reads: "The President or Vice-President shall cease to hold office if (a) by a resolution passed by two-thirds majority of all the members of the Executive Council of the Federation it is declared that the President or Vice-President is incapable of discharging the functions of his office; and (b) the declaration is verified, after such medical examination as may be necessary by a Medical Panel established under Sub-section 4 of this Section."
There was anxiety Day before yesterday among ministers, following plans by some of them to ask the Federal Executive Council (FEC) to reconsider its stand on the President’s health.
The cabinet has said President Umaru Yar’Adua is not incapacitated. He has been in Saudi Arabia since November 23, last year for health reasons. Vice President Goodluck Jonathan is Acting President, after a long row.
But some ministers, are to push for the invocation of Section 144 to determine Yar’Adua’s health status.
In the back and forth, Solid Minerals Minister, Diezani Allison-Madueke, aligned herself with the memo written on February 3 by Information and Communications Minister, Dora Akunyili, and argued that it is necessary for the FEC to do the needful.
Allison-Madueke was, in turn, countered by Minister of State for Education, Aisha Dikku, who agreed with Aliero that there is no need to invoke Section 144 in dealing with Yar'Adua's absence since Jonathan now acts as President.
It could also be recalled that the Nobel laureate, Prof. Wole Soyinka, and some members of the Save Nigeria Group have challenged the Executive Council to review its position on Section 144,
It was learnt that some ministers have perfected the plot which may not come through a motion before FEC. (Holding Today).
This meeting is suppose to determine ,If Goodluck will still retain his prefix-"Acting" or have it removed.
Contrary to the claim of a unified Presidency, ministers have been meeting in line with their split either in favour of President Umaru Yar’Adua or the Acting President.
"The two camps have been mutually suspicious of each other."
